14 DAYS AFTER NOTICE OF LIEN

  • Owner may enter storage space and remove personal property to a safe place. If protected property is discovered, special handling will be required.

  • If property is a motor vehicle, boat or personal water craft there is a 60 day waiting period to remove or tow.

BREAK DOWN OF OUR SERVICES

o    RCMS will send the notice of sale to the occupant at least 14 days before the sale is scheduled to take place.

o   Declaration of opposition information will be included with the notice.Should the occupant submit a declaration of opposition within the 14 days, they will be entitled to an additional 21 days to submit and substantiate the declaration. Owner is prevented from selling property for at least 30 days after receipt of declaration.

o      When the correct sale date is established, RCMS will submit the required advertisement for two consecutive weeks proceeding the date of sale in a newspaper of “general circulation”.   

o  All charges for this advertisement will be submitted to the owner for payment.

o        RCMS will monitor and manage all time sensitive actions to insure compliance and timely legal actions.

·o        RCMS will help insure that the sale is conducted in a “commercially reasonable manner” and that all allowable costs are deducted from sale proceeds

.·o   Excess proceeds from the sale will be retained by the owner for up to one year. If they are not claimed they shall be surrendered to the county.

a final accounting will be prepared by r.c.m.s.
